Art Off the Rails Rules & Regulations

 Check in/Set up time is 8:30 - 10:30 AM. Please have your booth open and operational by 11:00 am. Bring your own stands, tables, displays. Your canopy must be secured with weights (no exceptions), and we highly recommend that you have roll-down sides for your canopy. (the weather is always unpredictable)

Cleanup time is 4:00-5:00 PM

Event participation is at your own risk.

Indemnification.

1.         To the extent provided by law and irrespective of any insurance required of the Applicant, the Applicant shall defend and indemnify North Bend Art & Industry from any and all Claims arising out of or in any way relating to this application; provided, however, the indemnification requirements of this paragraph shall not apply to that portion of such Claim that reflects the percentage of negligence of North Bend Art & Industry compared to the total negligence of all persons or other entities that resulted in the Claim.

2.         Applicant agrees that the provisions of this paragraph apply to any claim of injury or damage to the persons or property of applicant’s employees. As to such claims and with respect to North Bend Art & Industry, applicant waives any right of immunity, which it may have under industrial insurance (Title 51 RCW and any amendment thereof or substitution therefore). THIS WAIVER IS SPECIFICALLY NEGOTIATED BY THE PARTIES AND IS SOLELY FOR THE BENEFIT OF NORTH BEND ART & INDUSTRY, THE CITY OF NORTH BEND, AND APPLICANT.

3.         As used in this application: (1) “NBA&I” includes the “N B A & I ’ S ” officers, employees, agents, and representatives; (2) “City” includes the City’s officers, employees, agents, and representatives (3) “Applicant” includes employees, agents, representatives, and subsidiaries, parents, and affiliate entities; and (4) “Claims” include, but is not limited to, any and all losses, claims, causes of action, demands, expenses, attorney’s fees and litigation expenses, suits, judgments, or damage arising from injury to persons or property.

4.         Applicant shall ensure that each sub-vendor/applicant shall agree to defend and indemnify North Bend Art & Industry and the City of North Bend to the extent and on the same terms and conditions as the applicant pursuant to this paragraph.

There are no refunds, partial or otherwise given for any of these reasons. There are no guarantees that the application will be accepted. Artist selection is the sole discretion of the NBA&I.

North Bend Art & Industry reserves the right to remove ANY artist from the event, without refund, for misrepresentation of products, inappropriate conduct, or failure to comply with the vendor guidelines and regulations as set forth by NBA&I. NBA&I reserves the right to accept or deny any application.
